Rental Agreement

The renter acknowledges reading, understanding, and agreeing to all terms and conditions of this contract and confirms receipt of a copy.

The renter confirms that the vehicle, including all accessories and equipment, was received in proper, safe, and satisfactory condition.

The renter agrees to return the vehicle to the lessor at the location and date specified in the contract, or earlier if demanded. Failure to return the vehicle on time will result in a charge equal to a full day's rental, with a one-hour grace period.

Only individuals listed on the rental agreement or otherwise legally authorized, and who meet the minimum age requirement of 21 (or the applicable state/province age requirement), may operate the vehicle.

The lessor may apply the renter's deposit toward any amounts owed under this agreement.

No refunds will be issued except in cases of repeated mechanical failure.

The renter must operate the vehicle responsibly and is liable for all damages to the vehicle and injuries to passengers not covered by the vehicle's insurance policy.

In the event of an accident, the renter must immediately report it to law enforcement and to the lessor. The renter may not leave the scene until police have arrived and all required reports have been completed.

The vehicle must be returned to the designated location with all tires, tools, accessories, and equipment in the same condition as received, except for normal wear and tear.

The lessor may repossess the vehicle without notice if it is illegally parked, used unlawfully, abandoned, or used in violation of this agreement.

The vehicle may not be operated:

a. In violation of any law or the terms of this agreement

b. To transport passengers or goods for compensation

c. To tow or push any vehicle or object

d. By anyone not listed on the agreement without written consent

e. Off-road or on unmarked or unsafe terrain

f. By any person using false or misleading information

g. Outside the continental U.S. or Canada

h. In any race, contest, or speed event

Any violation of laws or this contract by the renter or an authorized driver makes the renter fully responsible for all resulting damages, regardless of cause.

The lessor is not responsible for loss or damage to personal property left inside the vehicle at any time.

The renter agrees to pay, upon demand:

a. A deposit equal to the estimated rental cost

b. All expenses incurred to return the vehicle to the agreed station if left elsewhere

c. The full value of any tires, tools, or accessories lost, damaged, or stolen

The renter may not repair or alter the vehicle or allow any liens to be placed on it without the lessor's written consent. The renter must pay for all unauthorized charges.

Rental fees must be paid in advance. The renter is responsible for all collection costs incurred by the lessor.

A credit card is required for all rentals and may be charged for extra rental days, added insurance, parking fines, fuel charges, damages, or any costs arising from the renter's use of the vehicle.

The vehicle must be returned clean and free of garbage.

Fees: $100 cleaning fee for dirty vehicle; $200 fee for smoke or ash odor.

Fuel discrepancy charges: Sedans — $50 if returned with less fuel than at pickup; SUVs — up to $100.

Flat tires caused by road hazards are the renter's responsibility. Renter must contact the owner for instructions if a flat occurs.

The renter must maintain proper oil and water levels. Engine damage due to neglect is the renter's responsibility.

If the vehicle overheats, the renter must immediately shut it off and notify the owner. Failure to do so makes the renter fully liable for any resulting damage.

Parking fines are the renter's responsibility. Failure to pay may result in the lessor paying the fine and charging the renter the fine amount plus a $25 handling fee.

Tolls are the renter's responsibility. If not paid at check-in, a $25 handling fee will be assessed.

The renter is responsible for broken glass or other damage unless caused by an accident in which another driver is legally at fault.

The vehicle may be driven only within the United States and Canada unless otherwise approved by the local agent.

Liability and driver insurance are governed by state/province law.

The renter is responsible for all damages caused to others and must provide auto liability insurance covering the renter, the lessor, and the vehicle.

The renter and lessor reject PIP, no-fault, and uninsured/underinsured motorist coverage.

Allowing an unauthorized driver to operate the vehicle voids any liability coverage.

The renter must indemnify and defend the lessor against all liability, costs, and attorney fees arising from vehicle use beyond insurance coverage.

A Collision Damage Waiver (CDW) may be purchased to limit liability.

The CDW does not cover damages resulting from: intentional acts or gross negligence; driving under the influence of alcohol or drugs; water damage to the engine; racing or test-driving; civil unrest, war, or sabotage; burns to interior materials; damage to wheels, tires, batteries, springs, glass, or radio; underbody damage from rough or uneven roads; off-road driving, beaches, rivers, snow piles, etc.; sand, dust, ash, lava, or similar environmental elements; damage from ocean transport; wind-blown doors; failure to remove keys or secure the vehicle, resulting in theft.

The renter must pay all legally permitted charges, including:

a. Rental time and usage

b. Optional services selected

c. Applicable taxes

d. Loss or damage to the vehicle, including loss of use, diminished value, and administrative fees

e. Fines, penalties, towing, and court costs

f. Costs to locate and recover the vehicle

g. Collection costs and attorney fees

h. Late fees (2% or maximum allowed by law)

i. Interest at 1.5% per month or maximum allowed

j. $50 plus $5 per 2 km for unauthorized return location, plus recovery expenses

A waiver of any breach does not waive future breaches.

Unless prohibited by law, the renter releases the lessor from all consequential, special, or punitive damages.

If any part of this agreement is invalid, the remainder remains in effect.

This document constitutes the entire agreement.

Cancellation 5 or more days before pickup: Full refund.

Cancellation within 5 days of pickup: 50% refund.

Cancellation less than 48 hours before pickup: No refund.

The lessor may perform a final audit and apply necessary adjustments.

Contract terms may only be modified in writing.

To extend the rental, the renter must return the vehicle for inspection and sign a written amendment.
